Abstract: As a special robbery, the elements of transforming robbery are very different from the general robbery. Furthermore, due to the inborn deficiency in legislation and transformation of crime pattern in social life, academics have various arguments for the conditions of transforming robbery and its determination in judicial practices. The focus of arguments mainly concentrates on the elements of transforming robbery, which includes precondition, objective condition and subjective condition. Among them, the existence of precondition is the issue with the most arguments. Therefore, it is necessary to amend the relevant articles of the Criminal Law of the People’s Republic of China for a better determination and treatment of transforming robbery.
