我国2001年婚姻法致力于损害与救济之间的平衡,设立了较为完整的离婚救济制度，从而更有效的保护离婚当事人的合法利益。离婚经济帮助制度能够有效保护离婚后贫困一方的合法权益，实现了权利的平衡，有助于维护婚姻的稳定。但是具体制度设计还存在一些缺陷，使得经济帮助制度在司法实践中难以适用，法官的衡量标准无所依据，本文具体考察分析我国现行制度的缺陷与不足,提出了完善我国离婚经济帮助制度的立法构想，为社会和谐提供法治保证。
